For over 20 years, David has acted as real estate counsel for individuals, closely-held businesses, educational institutions, public libraries and Fortune 100 companies, on matters pertaining to real estate acquisition, development, re-development, construction, financing and leasing, environmental compliance and insurance, construction, intellectual property and business acquisitions and divestitures. In 2001, together with Michael Blumenthal, David formed Waxman Blumenthal LLC as a boutique real estate, construction and environmental practice.

A cross-section of David’s experience includes:

  • Representation of a Fortune 500 company in the sale of a 100-year-old, 52-acre former manufacturing facility in North Canton, Ohio to a developer seeking to reposition the site as a mixed-use development. The property was made up of over 100 separate parcels that had be acquired over the property’s 100-year history and was subject to both United States and Ohio EPA oversight, all of which required pinpoint teamwork, creative title work and the use of environmental insurance, indemnities and guaranties.
  • Assisting a developer with the acquisition and financing of a proposed 500-acre mixed-use development in Raleigh, North Carolina, including the limited offering of securities to investors in a joint venture partner of the developer.
  • Assisting a public library with construction-related matters (including public bidding requirements) in connection with the major renovation of its main facility.
  • Assisting public school districts in connection with construction-related documents and public bidding matters.
  • Representation of a major drug store company in connection with the sale and leasing of locations in multiple locations in the United States.
  • Serving as counsel to developers and investors on a wide array of matters on project such as office building, gas stations, warehouse/distribution facilities, condominium and planned unit developments, apartment complexes, residential subdivisions, shopping centers and hotels.
  • Serving as counsel to both lenders and borrowers in connection with both construction and permanent financing.

David is a past Chair of the Cleveland Bar Association’s (now the Cleveland Metropolitan Bar Association) Real Estate Law Section. He has spoken at numerous seminars, including the Cleveland Metropolitan Bar Association’s annual Real Estate Law Institute, for which he served as the event’s Co-Chairman in both 1997 and 1998. David also served on the South Euclid, Ohio, Zoning Board of Appeals in 1996 and was a Ward Councilman from 1996 to 1999, serving as Chairman of its Legislative Committee and Member of its Planning and Zoning Committee. A member of the American and Cleveland Metropolitan Bar Associations, David is also a member of the National Association of Industrial and Office Properties. David has been named a “Leading Lawyer” by Northeast Ohio’s Inside Business Magazine and Ohio Business Magazine from 2002-2008. He is also on the board of trustees of the Cleveland Hebrew Schools.

Prior to forming Waxman Blumenthal, David practiced law at Cole, Raywid & Braverman (now Davis Wright Tremaine), in Washington, D.C., and Bricker & Eckler, in Columbus, Ohio, and was formerly general counsel to Consolidated Management, Inc., a Cleveland, Ohio real estate development and investment company.
